1The Tribunal issued a Case Assessment Direction on March 20, 2012, which contained the following paragraphs:
- This matter is scheduled for hearing for two days commencing March 22, 2012. The Tribunal attempted to arrange a pre-hearing teleconference with the parties to prepare for the hearing in light of the fact that the applicant had not complied with the Rules requiring the filing of hearing documents and witness statements.
- The applicant replied to the request for a teleconference by email dated March 18, 2012, indicating that he does not have time to pursue the Application.
- Based on the applicant’s email, it appears that he wishes to withdraw the Application. Given the short time left before the hearing, I waive the requirement to file a Form 9 (Request to Withdraw) and Form 23 (statement of delivery).
- The Registrar will cancel the scheduled hearing dates. If no objection or comment is received within three days of this Case Assessment Direction, the Tribunal will grant leave to withdraw the Application and close its file.
2No objection or comment has been received since this CAD was issued. Accordingly, the Application is dismissed as abandoned.
