1This is an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the ”Code”).
2On December 13, 2011, a Notice of Summary Hearing was sent to the parties advising that the summary hearing would commence at 9:30 a.m. on March 28, 2012. The Notice of Summary Hearing also advised the parties how to connect to the teleconference.
3The summary hearing was scheduled pursuant to the Case Assessment Direction dated November 9, 2011 (the “CAD”). In this CAD the Tribunal directed that the applicant should proceed to make submission first to explain why the Application should not be dismissed as having no reasonable prospect of success.
4On January 31, 2012 the applicant corresponded with the Tribunal by email requesting that a Spanish interpreter be made available for the March 28, 2012 hearing.
5On March 28, 2012 the applicant did not call in nor participate in the summary hearing. As is customary, the Tribunal waited until 10 a.m. At 10:00 a.m., the applicant was still not present.
6I was satisfied at the hearing that the applicant had received notice of the summary hearing. In the absence of the applicant or any explanation for his failure to attend the hearing, I dismissed the Application as abandoned.
ORDER
7The Application is dismissed.
