1This is an Application filed on September 2, 2011, under section 34(1) of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code").
2The Tribunal sent the Notice of the Application to the respondent at the address provided by the applicant. Its correspondence has been returned. The applicant has advised the Tribunal that the respondent has moved and he does not know a forwarding address for it. The Tribunal then sent a letter to the applicant on January 18, 2012, directing his attention to Rule 6.6(a) and (b) of the Tribunal's Rules which state, among other things, that an Application will not be dealt with in respect of a respondent who cannot be contacted at an address provided in the Application. The Tribunal requested that the applicant provide a current address for the respondent, or reasons why the address in the Tribunal's file is in fact current.
3The Tribunal stated that failure to provide the information requested may lead to dismissal of the Application
4The applicant has not responded to the Tribunal's letter and the deadline for doing so has passed. In the circumstances, the Application is dismissed as abandoned.
