BACKGROUND
1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the “Code”), on February 7, 2011.
2The respondent filed a Response on September 9, 2011, requesting that, “the Application be dismissed in its entirety”.
3Pursuant to s. 43(2) of the Code and Rule 19A of the Tribunal’s Rules of Procedure, a summary hearing by teleconference was held before me on March 14, 2012. The purpose of the summary hearing was to determine whether the Application should be dismissed, in whole or in part, on the basis that there was no reasonable prospect that it would succeed.
4The applicant participated in the summary hearing on his own behalf. The respondent also participated through counsel.
5The applicant advised at the start of the hearing that he wished to withdraw the application.
ORDER
6On consent, the Application is dismissed.
