1This Application was filed on May 2, 2011, pursuant to s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”). The respondent filed its Response on September 26, 2011.
2Though there are currently outstanding Requests by the respondent to defer and/or dismiss all and/or part of the Application, this Interim Decision only addresses the applicant’s Request for an Order During Proceedings to amend his Application (the “Request to amend”) filed on November 17, 2011. In the Request to amend, the applicant includes a Schedule A, which includes new allegations of discrimination that allegedly occurred after the filing of the Application.
3On November 25, 2011, counsel for the respondent wrote to the Tribunal to advise that the respondent consented to the applicant’s Request to amend his Application.
Order
4Therefore, the Tribunal makes the following Orders:
a. The Application is amended to include the Schedule A attached to the applicant’s Request to amend; and
b. The respondent may file an amended Response within twenty-one (21) days of the date of this Interim Decision.
5The Tribunal may issue further directions and/or orders to address the outstanding issues between the parties.
