2By Case Assessment Direction dated January 9, 2012, the Tribunal directed the applicant to respond to the request of the respondent to dismiss the Application on the basis of timeliness. The Tribunal stated that if no response was filed by the applicant, it may determine the request to dismiss on the basis of the material before it or may dismiss the Application as abandoned.

3The applicant has not filed a response to the request and the time for doing so has passed.

4In the circumstances, the Tribunal deems the Application abandoned and it is dismissed.
