1This is an Application filed on March 2, 2011 under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19 as amended (the “Code”), alleging discrimination in employment on the basis of disability.
2By letter dated December 28, 2011, the respondent advised the Tribunal that the applicant is deceased. On January 23, 2012 the Tribunal wrote to the applicant’s estate care of George Robert, identified as the applicant’s representative in respect of the Application. The Tribunal’s letter advised the estate that the Application could not be processed further unless the Tribunal receives a confirmation that the applicant’s estate intends to pursue the Application. The letter stated that the Application would be dismissed if the estate did not communicate with the Tribunal and the other party to the Application by February 13, 2012.
3To date, the Tribunal has received no communication from the applicant’s estate. The Tribunal’s letter of October 31, 2011 has not been returned as undeliverable.
4In these circumstances, the Application is dismissed as abandoned. The hearing scheduled for June 7, 2012 is cancelled.
