1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code"), on May 24, 2011.

2On November 17, 2011, the Tribunal held a mediation. The parties did not file a settlement (Form 25) following the mediation and requested additional time to reach a settlement. The Tribunal has made several attempts since that time to contact the parties.

3On January 11, 2012, the Tribunal sent a Registrar's letter to the parties and advised the applicant that she must file a Request to Withdraw (Form 9), Settlement (Form 25) or advise the HRTO and the respondents in writing whether she intends to proceed with the Application. The letter warned the applicant that a failure to respond to the letter in writing by January 25, 2012, may be deemed an abandonment of the Application.

4As of the date of this Decision, the applicant has not responded to the Tribunal and the Tribunal's correspondence to her has not been returned.

5In the circumstances, the applicant is deemed to have abandoned the Application and the Application is dismissed.
