1A Summary Hearing was scheduled in this matter for February 17, 2012, in accordance with the Case Assessment Direction issued on October 17, 2011. This hearing was conducted by conference call. The Tribunal and counsel for the respondent participated in this hearing; however, the applicant did not join the conference call. The Tribunal and respondent counsel waited thirty (30) minutes in order to ensure that the applicant had the required opportunity to participate in the hearing. The applicant did not join the conference call and, according to the information available to the Tribunal at the time, he did not make any effort to advise the Tribunal of any difficulty or obstacle to his participation in the hearing.
