1A hearing by conference call is scheduled in this matter for Thursday, January 12, 2012, from 1:30 p.m. to 4:30 p.m. A Notice of the Hearing was sent to the parties on November 21, 2011. The issues to be addressed in the hearing were described in the Tribunal’s Case Assessment Direction of February 23, 2011.

2On December 13, 2011, the applicant sent a letter to the Tribunal by fax, dated December 7, 2011, advising that he had retained counsel to appear at the hearing on January 12, 2012.

3On January 6, 2012, counsel, who is the individual named in the applicant’s correspondence, requested an adjournment of the hearing, on the basis that there is a large volume of documentation and he requires time to adequately prepare for the hearing.

4Counsel for the respondent Expertech Network Installation Inc. has objected to the request.

5Given that applicant’s counsel was retained more than a month before the scheduled hearing and the issues to be addressed have been known to the applicant since February 2011, the request is denied. The hearing will proceed as scheduled.
