1This Application, filed on June 10, 2010, under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleges discrimination in employment based on disability.
Decision to Grant Request to Remove a Personal Respondent
2On August 23, 2011, the applicant filed a Request for Order During Proceedings to remove Marianne Gibbs as a personal respondent, and the respondents wrote to the applicant and the Tribunal on September 9, 2011, to state that they have no objection. The parties afterwards attempted to settle the Application in mediation, but the matter did not resolve, and will proceed to a hearing. In the circumstances, I am satisfied that Marianne Gibbs should be removed as a personal respondent. The style of cause is amended accordingly.

3In the Response, the respondents requested that all of the personal respondents be removed and they provided submissions. The applicant has not responded to their request. She must therefore file with the Tribunal and deliver to the respondents her position with respect to the respondents’ request and any submissions to support her position, within 14 days of this Interim Decision.
