INTRODUCTION
1This is an Application filed under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
2In a previous Interim Decision, 2012 HRTO 264, the Tribunal forwarded a copy of the Interim Decision to the Ontario Human Rights Commission (the “Commission”) and directed the Commission to provide its position with respect to the release of the contents of OHRC File No. NMYS-3VTHAS to the parties to this Application and to the Tribunal.
3The Commission has done so in a letter dated February 28, 2012. It has indicated that if it is ordered to produce the above noted file, it will do so in accordance with its approach to disclosure and its Freedom of Information obligations.
ORDER
4The Commission is, therefore, directed to produce a copy of OHRC File No. NMYS-3VTHAS to the Tribunal within three weeks of the date of this Interim Decision subject to the Commissions approach to disclosure and its Freedom of Information obligations as outlined in its letter to the Tribunal and reproduced (in part) below, by severing or withholding:
(a) Any records that contain the personal information of individuals, other than the Respondent;
(b) Any records that contain staff advice; and
(c) Any records that the Commission is otherwise exempt or prohibited from disclosing under the Freedom of Information Act.
