1This is an Application filed on February 8, 2010, under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
2On December 7, 2010, the Human Rights Tribunal of Ontario (the “Tribunal”) issued an Interim Decision, CH.K. v. Ontario Hockey Federation, 2010 HRTO 2425 (“CH.K”), which placed this file in abeyance pending the completion of a “lead case”.
3The Tribunal issued a decision in the “lead case”, Co.K. v. Ontario Hockey Federation, 2012 HRTO 76 (“Co.K”), on January 13, 2012, dismissing it.
4On January 23, 2012, the Tribunal wrote to the applicant, enclosing a copy of the decision in Co.K, and requesting that the applicant advise the Tribunal and the respondents’ counsel in writing of his intention to proceed with the Application by February 22, 2012. The letter stated that if the applicant failed to do so, the Tribunal “may dismiss the Application as abandoned”.
5The Tribunal has received no correspondence from the applicant.
6In the circumstances, the Tribunal deems the Application abandoned and it is dismissed.
