INTERIM DECISION
Adjudicator: Michelle Flaherty
Date: February 28, 2012
Citation: 2012 HRTO 419
Indexed as: Cornutt v. The Community Legal Clinic of York Region
1This is an Interim Decision in respect of an Application under section 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”). In a Case Assessment Direction dated December 28, 2011, the Tribunal directed that the matter would proceed by way of a summary hearing. The respondents have been directed not to file a Response.
2On February 6, 2012, the applicant filed a Request for an Order During Proceedings (“Request”) seeking to amend the Application to revise and add to her desciption of the alleged incidents of discrimination. The respondents have not responded to the Request and the time for doing so under the Tribunal’s Rules of Procedure has elapsed.
3In view of the stage at which the Request to amend is made, the nature of the amendments, and the absence of any apparent prejudice, I see no reason to deny the applicant an opportunity to make the requested amendments to the Application.
4In these circumstances, the applicant’s request to amend the Application is granted.
5I am not seized.
Dated at Toronto, this 28th day of February, 2012.
