1This is an Application filed under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19 as amended (the “Code”).
2A Notice of Confirmation of Hearing, dated August 17, 2011 was sent to the parties informing them that the hearing into this matter is scheduled for January 25, 26 and 27, 2012.
3The deadline for filing witness statements and documents the parties intend to rely on at the hearing was December 12, 2011. The Tribunal received some materials from the respondents but received nothing from the applicant beyond a letter from his former counsel, dated November 15, 2011, advising the Tribunal that she no longer acted for the applicant.
4A Case Assessment Direction (CAD) was issued by the Tribunal on December 19th, 2011. The applicant was directed to serve and file witness statements and any documents he intended to rely upon by December 22, 2011.
5In addition, given the lack of any contact from the applicant, including his failure to file a response to a Form 10 filed by the respondents, the applicant was directed to confirm, in writing by December 22, 2011, whether he intends to participate in the scheduled hearing and proceed with this Application, failing which the Application could be dismissed as abandoned.
6The deadline set by the Tribunal has passed. The CAD has not been returned as undeliverable. The Tribunal has not received any materials or written confirmation from the applicant that he intends to participate in the scheduled hearing or proceed with this Application. The respondents confirm that they have not received any correspondence from the applicant either.
7In the circumstances, the applicant is deemed to have abandoned the Application and the Application is dismissed.
