1This is an Application filed May 10, 2010, under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging discrimination in employment on the basis of race, colour and ethnic origin. Oakville Senior Citizens Residence, Mary-Ellen Morrison and Lynda Clark (the “respondents”) filed a Response denying the allegations. Adventis Personnel Inc. (“Adventis”) filed a separate Response denying the allegations. This matter has been scheduled for hearing on January 25 and 26, 2012, in Toronto.
2This Interim Decision deals with a Request for an Order During the Proceedings (the “Request”) made by the respondents on December 1, 2011, seeking that the applicant provide them with particulars of her allegations. The applicant has not filed any submissions and therefore this Request is unopposed by the applicant.
3In the Request, the respondents identify at paragraph 4 the nature of the information sought, which includes allegations that other employees in the workplace were subjected to racial slurs and were also eventually terminated from employment. The applicant does not identify these employees.
4The respondents also seek particulars of allegations with respect to their alleged failure to accommodate the applicant’s disability-related needs, including the production of a Functional Abilities Form and Doctor’s notes. The respondents seek particulars as to when and to whom these requests for accommodation were made.
Decision
5The Tribunal finds that the particulars sought by the respondents are reasonably necessary to their ability to respond to the Application at the hearing. The Tribunal notes that the applicant has filed a summary of her anticipated evidence, which reiterates the allegations made in the Application without providing any further specifics.
6The Tribunal therefore Orders that the applicant shall deliver to parties and file with the Tribunal the particulars and documents sought at paragraph 4a) to 4f) of the respondent’s Request by January 12, 2012.
