1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”) on November 24, 2010. The Application alleges discrimination and harassment with respect to employment, on the basis of disability.
2Previously the Tribunal issued an Interim Decision, 2011 HRTO 1984, and a Case Assessment Direction (“CAD”) dealing with issues regarding the representatives of the applicant.
3In the Interim Decision, dated November 2, 2011, the Tribunal addressed the respondent’s objection that there were two individuals serving as legal representatives of the applicant without confirmation that these individuals were authorized under the By-Laws of the Law Society of Upper Canada (“LSUC”). The Tribunal ordered the applicant, on or before December 9, 2011, to provide to the Tribunal her representatives’ LSUC license numbers.
4In the CAD dated December 28, 2011, the Tribunal directed that within 14 days the applicant was required to write to the Tribunal and copy the respondent with confirmation of her representatives’ LSUC license numbers. The CAD expressly noted that if the applicant failed to comply with this requirement the Tribunal may dismiss the Application as abandoned.
5Neither the applicant nor her representatives have communicated or corresponded with the Tribunal in compliance with the Interim Decision or the CAD. The timeline for doing so has elapsed.
6In these circumstances, the Tribunal determines that the applicant has abandoned the Application.
7Accordingly, the Application is dismissed.
