1This is an Application under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19 as amended (the “Code”).
2On January 16, 2012, the Tribunal issued a Case Assessment Direction dealing with the effects of proceedings in bankruptcy in respect of the corporate respondent. The Tribunal specifically directed as follows:
…the Application may not proceed against the corporate respondent. If the applicant wishes to proceed with this Application, within three weeks of this Case Assessment Direction, she must advise the Tribunal and the other parties in writing: (a) whether the applicant intends to bring a motion to take other steps to lift the stay of proceedings; and, (b) in any event, whether the applicant wishes to proceed with the Application against the personal respondent. If the applicant fails to provide this information as directed, the Tribunal may deem the Application abandoned and close its file.
3The applicant has not advised the Tribunal in accordance with the information requested in its Case Assessment Direction, nor has the applicant otherwise communicated with the Tribunal, and the time for doing so has now passed.
4In the circumstances, the applicant is deemed to have abandoned the Application and the Application is dismissed.
