1This is an Application under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19 as amended, (the "Code") alleging discrimination in employment on the basis of disability. Mediation is scheduled for February 27, 2012.
2The purpose of this Interim Decision is to deal with the respondents' Request for Order During Proceeding ("Request") filed on July 19, 2011 requesting particulars prior to the mediation. The respondents have indicated that it may withdraw from participation in the mediation if the particulars are not provided.
3The respondents seek the particulars as outlined in the Request including "a list of the specific material facts which are relied upon by the Applicant and particulars as to how those facts demonstrate the Respondents, individually or collectively, violated the Code."
4I am not satisfied that the particulars outlined in the Request are required prior to mediation. The Tribunal's Rules provide for production where mediation does not resolve the Application and requests for particulars prior to mediation are discouraged.
5Mediation is a voluntary process and if the respondents do not wish to participate based on the information they now have, they may decline to do so. I note that the respondents were able to file a fulsome Response to the Application.
6The respondents are directed to confirm to the Registrar within seven days of the date of this Interim Decision whether they intend to participate at the mediation scheduled for February 27, 2012.
7The Request is denied.
