Human Rights Tribunal of Ontario
Between:
Darrell Villa Applicant
-and-
Megabus Respondent
Decision
Adjudicator: Eric Whist Date: February 2, 2012 Citation: 2012 HRTO 243 Indexed as: Villa v. Megabus
1This Application was filed on November 23, 2011 under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended. On December 16, 2011 the Tribunal issued a Notice of Incomplete Application and Notice of Intent to Dismiss to the applicant directing that he file a complete Application and submissions on the issue of whether the Tribunal has jurisdiction in this matter given that the respondent appeared to be a federally regulated business or service. The applicant was given a deadline of January 5, 2012 to provide the required materials. On December 28, 2011 the applicant wrote to the Tribunal to indicate that English is not his natural language and asking the Tribunal to facilitate an interpreter and arrange an appointment so the applicant could understand the issues.
2On January 9, 2012 the Tribunal wrote to the applicant to indicate that as a quasi-judicial neutral body it could not provide legal advice or help in preparing the applicant’s submissions. It provided the applicant with contact information for the Human Rights Legal Support Centre which provides legal advice and may provide legal representation for persons making applications to the Tribunal. The applicant was granted an extension until January 23, 2012 to complete his Application and file submissions with the Tribunal. The Applicant has not done so as of the date of this Decision.
3Given that the applicant has failed to file materials as directed the Application is dismissed as abandoned.
Dated at Toronto, this 2nd day of February, 2012.
