1By way of Interim Decision 2011 HRTO 1165, this Application was deferred pending the outcome of a proceeding before the Ontario Labour Relations Board (the "OLRB").
2On November 13, 2012, the applicant filed a Request for an Order During Proceedings seeking to reactivate his Application. The applicant notes that the OLRB issued a decision dated September 28, 2012, which was sent to the applicant under cover letter dated October 1, 2012. The applicant indicates that the OLRB matter is concluded.
3Given that the OLRB process has completed and the respondent has not filed any submissions opposing reactivation, I find that it is appropriate to reactivate this Application.
DIRECTIONS
4The Application is reactivated.
5The applicant has indicated an interest in mediation. As such, within 7 days of the date of this Interim Decision, the respondent is directed to write to the Tribunal, copied to the applicant, confirming whether or not it is amenable to participating in mediation.
6I am not seized of this matter.
