1This is an Application filed on October 29, 2010 under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
2The applicant filed a Request for an Order During Proceedings seeking the removal of the Workplace Safety and Insurance Board (WSIB) as a respondent to this Application. No other party has responded to the Request and the time for doing so has passed.
3On review of the material before me, I grant the Request. The WSIB is removed as a respondent and the style of cause is amended accordingly.
4In view of the removal of the WSIB as a respondent, the summary hearing scheduled for March 13, 2012 is cancelled. The applicant has requested that mediation proceed on this date instead. The remaining respondent has not indicated its consent to mediation. The respondent is directed to advise the Tribunal within seven days of this Interim Decision whether it consents to mediation and if it is available on March 13. If it does not consent to mediation, the Application will be scheduled for hearing.
