1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code"), on November 1, 2011.
2The Application was not resolved at mediation and a notice confirming hearing dates was sent to the parties. The respondent requested rescheduling in accordance with the Tribunal's Practice Direction and on October 9, 2012, the Tribunal sent an email to the applicant requesting that she provide her available dates for rescheduling the hearing. The applicant did not respond to this request.
3On November 6, 2012, correspondence was sent to the applicant by email and regular mail confirming the email request of October 9 as well as an unsuccessful attempt to contact the applicant by telephone on November 1, 2012. The Tribunal's correspondence to the applicant of November 6, 2012 directed the applicant to confirm her intentions with respect to the Application. The applicant was informed that if she wished to proceed with the Application she must respond to the email of October 9, 2012 and provide the Tribunal with agreeable dates for rescheduling. She was also advised that if she did not respond to this correspondence by November 16, 2012, the Application could be dismissed as abandoned.
4To date, the applicant has not responded to any of the Tribunal's correspondence.
5In the circumstances, the applicant is deemed to have abandoned the Application. The Application is dismissed.
