BACKGROUND
1The applicant filed an Application on December 23, 2010, pursuant to section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19.
2A Response was filed on June 21, 2011.
3On December 15, 2011, a Notice of Confirmation of Hearing was mailed to the applicant at the postal address indicated in the Application. On January 2, 2012, Canada Post returned the Notice of Confirmation of Hearing marked “Moved/Unknown”.
4The Tribunal attempted to contact the applicant at the telephone at the number listed in the Application. The telephone operator indicated that the number had been changed, and provided a new telephone number. The Tribunal attempted to contact the applicant at the second number but an automated message indicated the number was not in service.
5No email address or fax number was provided by the applicant in her Application.
6The applicant has not contacted the Tribunal since April 29, 2011. Further, she has not complied with Rule 1.13 of the Tribunal’s Rules of Procedure, which requires parties to provide up-to-date contact information.
ANALYSIS
7Tribunal Rule 5.5 states:
The Tribunal may finally determine an Application without further notice to any person who cannot be contacted by the Tribunal according to the contact information provided to the Tribunal by that person.
8In the circumstances, I find that the Application has been abandoned. The applicant has not contacted the Tribunal and has not provided accurate and up-to-date contact information in accordance with Rule 1.13. The Tribunal has attempted to contact the applicant, but has been unable to do so.
ORDER
9The Application is dismissed.
