1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code"), on May 18, 2010.
2By Interim Decision dated January 4, 2011, 2011 HRTO 10, the Tribunal deferred proceeding with this Application pending the conclusion of an ongoing investigation by the Office of the Independent Police Review Director ("OIPRD").
3On September 10, 2012, the Tribunal wrote to the parties by regular mail and email. The applicant was asked to advise the Tribunal within 30 days of the date of the letter whether the investigation at the OIPRD remained ongoing and, if possible, to indicate when it was expected to be completed. The letter went on to warn the applicant that failure to provide the information as requested might result in the Tribunal dismissing the Application as abandoned.
4The applicant has not responded to the Tribunal's letter of September 10, 2012, and the time for doing so has passed. The Tribunal's correspondence was not returned to the Tribunal as undeliverable.
5In the circumstances, the applicant is deemed to have abandoned the Application and the Application is dismissed.
