Introduction
1This is an Application filed under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code"), alleging discrimination with respect to employment because of disability. The respondent filed a Response on April 2, 2012. The matter is scheduled for hearing in Toronto on April 2, 2013.
2This Interim Decision deals with a Request for an Order during Proceedings filed by the respondent on October 23, 2012 in which it seeks to amend its Response (the "Request to amend"). The applicant has not filed a Response to the Request to amend.
Order
3Having reviewed this matter, I find that it is fair and just to allow the Request to amend which in essence explains the respondent's position in more detail.
4The Tribunal orders:
a. The Response is amended to include the schedule attached to the respondent's Request to amend; and
b. The applicant, if he wishes, can file a Reply to the amended Response within 14 days of the date of this Interim Decision.
5I am not seized.
