1The applicant filed this Application on January 10, 2012, under section 34 of the Ontario Human Rights Code, R.S.O. 1990, c. H.19, as amended.

2A mediation was scheduled in this Application on July 30, 2012.

3On the morning of July 30, 2012, the applicant contacted the Tribunal by telephone to advise that she would not be able to attend the mediation as a result of a family emergency.

4On October 5, 2012, the Tribunal wrote to the applicant and directed her to confirm her intentions with respect to proceeding with the Application and whether or not she wishes to participate in mediation. The Tribunal directed the applicant to write to the Registrar, copied to the respondent, indicating her intentions by no later than October 15, 2012.

5On November 6, 2012, the Tribunal issued a Case Assessment Direction instructing the applicant to write to the Tribunal, copied to the respondent, confirming her intentions regarding whether or not she wishes to proceed with the Application. The Case Assessment Direction expressly noted that if the applicant does not confirm her intentions in writing within the required deadline, the Application would be dismissed as abandoned.

6The applicant has not corresponded or communicated with the Tribunal since the date of the cancelled mediation and did not comply with the Case Assessment Direction.

7Accordingly, the Application is dismissed as abandoned.
