1This Application was deferred by way of Interim Decision 2010 HRTO 1387 pending the conclusion of the applicant’s grievance process.
2On December 8, 2011, the applicant filed a Request for Order During Proceedings requesting that the Application be reactivated because she withdrew her grievance. The applicant’s materials indicate that her grievance was proceeding before arbitration at which time she instructed her union to withdraw the grievance. The applicant provided a copy of the arbitrator’s decision, dated November 7, 2011, indicating that the grievance was dismissed.
3The respondents have not filed a response to the applicant’s request to reactivate the Application.
4Given that there no longer appears to be a concurrent grievance process, the request to reactivate the Application is granted.
5I am not seized of this matter.
