1This is an Application filed under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging discrimination with respect to goods and services because of age colour and race.
2On October 12, 2012, the Tribunal issued a Notice of Intent to Dismiss this Application because it appeared to be outside of the Tribunal’s jurisdiction because the last incident complained of occurred more than one year prior to the Application being filed or how the incidents described constitutes an incident of discrimination within the meaning of the Code.
3The applicant was directed to file her submissions in response to the NOID on or before November 2, 2011 failing which the Tribunal would determine its jurisdiction to deal with it based on the material filed to date or, may dismiss the Application as abandoned.
4The applicant has not responded to this Application in any manner whatsoever and appears to have abandoned it. The Application is accordingly dismissed as abandoned.
