1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19 as amended (the "Code"), on May 25, 2011.
2On July 25, 2012, the applicant wrote to the Tribunal requesting that her Application be withdrawn.
3On September 5, 2012, the Tribunal wrote to the applicant advising her that to withdraw the Application she must either file a Statement of Delivery (Form 23) to confirm that a copy of the request to withdraw has been provided to the respondent or that she may provide her consent to the Tribunal to allow the Tribunal provide a copy of the request to withdraw to the respondent. The Tribunal requested that the applicant provide this information to the Tribunal on or before September 10, 2012. The applicant did not respond to this request.
4On October 3, 2012, the Tribunal wrote to the Applicant reminding her of the Tribunal's earlier request of September 5, 2012 and, again, sought a response from the applicant on or before one week from the date of the letter. The letter advised the applicant that should she not respond in the time frame set out in the letter, the application will be dismissed as abandoned. The applicant did not respond to this letter and the time for responding has now passed.
5In the circumstances, the applicant is deemed to have abandoned the Application.
6The Application is dismissed.
