1This is an Application filed under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging discrimination with respect to employment because of race, colour and ethnic origin.
2The Tribunal issued a Notice of Intent to Dismiss dated September 13, 2012 advising the applicant that the respondent appears to be a federally regulated government agency.
3Because of the nature of this Decision I have not found it necessary to include in the style of cause the names of all of the individuals who were included as individual respondents in the application.
4The Notice directed the applicant to make submissions in relation to the jurisdictional issue by October 15, 2012. The Notice also indicated that if the applicant did not file written submissions by the required time the HRTO may consider the failure to respond as an abandonment and dismiss the Application for that reason.
5The applicant did not file submissions. As a result, I conclude that the applicant has abandoned the Application.
6Accordingly, the Application is dismissed.
