Introduction
1This is an Application filed under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging discrimination with respect to services because of race, colour, ancestry, place of origin, citizenship, ethnic origin and association with a person identified by a prohibited ground under the Code.
2The parties received a Notice of Confirmation of Hearing dated February 17, 2012 scheduling the hearing for 9:30 a.m., October 18, 2012 in Ottawa, Ontario. At the time the Notice was issued the applicant was represented by counsel. Following the Notice the parties complied with the requirements to exchange disclosure. Counsel for the applicant withdrew on April 11, 2012 and from that point forward, communications were sent directly to the applicant.
3The Hearing was convened in person on October 18, 2012 at 9:30 a.m. Counsel for the respondents was present at the scheduled time. The applicant did not attend the hearing.
4I advised those present that the applicant would have 30 minutes to appear and that the hearing would commence at 10:00 a.m. At 10:00 a.m. the applicant was still not present.
5I was satisfied that the applicant’s representative received notice of the Hearing date. In the absence of the applicant or any explanation for her failure to attend the hearing, I dismissed the Application as abandoned.
ORDER
6The Application is dismissed.
