DECISION
Adjudicator: Alison Renton Date: October 18, 2012 Citation: 2012 HRTO 1964 Indexed as: Koostachin v. Chartrand Equipment
1This is an Application filed on June 19, 2012 under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging discrimination with respect to employment because of race, colour, ancestry and ethnic origin.
2On August 30, 2012, the Tribunal sent a Notice of Incomplete Application and Notice of Intent to Dismiss Application (collectively “the Notice”) to the applicant. In the Notice, the Tribunal advised the applicant that information on the Application form was missing. Further in the Notice, the applicant was advised that his Application appeared to be outside the Tribunal’s jurisdiction, specifically that the narrative setting out the incident of alleged discrimination failed to identify any specific acts of discrimination within the meaning of the Code. The Tribunal directed the applicant to provide the required missing information and submissions about the Tribunal’s jurisdiction by September 19, 2012, failing which the Application may be dismissed as abandoned.
3The applicant has not provided the missing information to the Tribunal, provided submissions about the Tribunal’s jurisdiction, or otherwise communicated with the Tribunal.
4Accordingly, the Application is dismissed as abandoned.
Dated at Toronto, this 18th day of October, 2012.
