DECISION
Adjudicator: Alison Renton Date: October 16, 2012 Citation: 2012 HRTO 1962 Indexed as: Camacho v. Martinway Contracting Ltd.
1This is an Application filed on July 16, 2012, under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code"), alleging discrimination with respect to employment because of record of offences.
2On August 30, 2012, the Tribunal sent to the applicant a Notice of Intent to Dismiss Application ("the Notice") and stated that it appeared that the Application was outside of the Tribunal's jurisdiction because: a) a review of the Application and the narrative setting out the incidents of alleged discrimination fails to identify any specific acts of discrimination within the meaning of the Code; and b) the information in the Application fails to describe how the respondents' behaviour was related to discrimination on the basis of "record of offences" as described in the Code. The Tribunal directed the applicant to provide submissions about the Tribunal's jurisdiction by September 29, 2012, failing which the Application may be dismissed as abandoned.
3The applicant has not provided submissions about the Tribunal's jurisdiction, or otherwise communicated with the Tribunal since the Notice was issued.
4Accordingly, the Application is dismissed as abandoned.
Dated at Toronto, this 16th day of October, 2012.
