INTERIM DECISION
This is an Application filed under section 34 of the Human Rights Code, R.S.O. 1990, c.H.19, as amended, (the "Code").
On January 18, 2012, a Response was filed. Among other things, the respondent sought to defer the Application pending the resolution of a related criminal charge.
By letter dated June 6, 2012, the Tribunal delivered the Response to the applicant and sought her reply along with submissions on the respondent's request to defer.
On July 25, 2012, the applicant filed her Reply, which included the submission that the request to defer was moot because she was advised by counsel for the respondent that the charges had been withdrawn on July 17, 2012.
By Case Assessment Direction dated August 21, 2012, the Tribunal asked the respondent to respond to the applicant's position.
No response has been received and the time for responding has elapsed.
Based on the material filed, it would appear that the Request to Defer is moot.
In the circumstances, the Request to Defer is denied. The Application will continue to be processed.
