Introduction
1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19 as amended (the “Code”), on April 10, 2012.
2On September 14, 2012 the Tribunal received by mail a Statement of Delivery (Form 23) from the applicant. The Form 23 indicated that the applicant had sent a Request to Withdraw Application (Form 9) to the respondent.
3The Tribunal sent a letter to the applicant on September 21, 2012 indicating that the Tribunal had attempted to contact him by telephone but had not been able to make contact with him. The Tribunal directed the applicant to file the Form 9 with the Tribunal. The letter warned that if he did not respond to the letter within 14 days, the Application could be dismissed as abandoned.
4To date, the applicant has not responded to the Tribunal’s correspondence.
5In the circumstances, the applicant is deemed to have abandoned the Application and the November 1, 2012 mediation date is cancelled.
6The Application is dismissed.
