1This is an Application filed on June 22, 2012 under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”). This Interim Decision addresses the fact that the Tribunal does not have contact information for one of the named individual respondents, Verlene Dechosa.
2The Application names a corporate respondent as well as six individual respondents. The corporate respondent and five of the individual respondents have filed Responses and have indicated that the remaining individual respondent, Verlene Dechosa, is no longer with the corporate respondent.
3Ordinarily, it is the responsibility of an applicant to provide accurate contact information and the Tribunal relies on applicants to provide a correct address for respondents named in their applications. In this case, however, the corporate respondent may have knowledge of how to contact Verlene Dechosa. Given these circumstances, the Tribunal will order the corporate respondent to provide this contact information so that the Application may be delivered to Verlene Dechosa.
4Even if Verlene Dechosa is no longer with the corporate respondent she must still file a response in accordance with the Tribunal’s Rules, since she is named as respondent to the Application. The requirement to file a response does not preclude her or any respondent, from raising any issue with respect to their involvement in the Application, including whether they are proper respondents.
5The Tribunal therefore directs Friendly Times Child Care Centre to provide the applicant and the Tribunal with the last known address of Verlene Dechosa within fourteen (14) days of this Interim Decision, following which the Tribunal will deliver notice of the Application to this individual at the address provided.
6I am not seized of this matter.
