1This Interim Decision addresses a Request for Order during Proceedings (“Request”) from the respondents in relation to the applicant’s failure to comply with the disclosure requirements set out in Rule 16 of the Tribunal’s Rules of Procedure (“Rules”). The Application is scheduled for hearing on January 21 and 22, 2013.
2Rule 16 requires the parties to deliver to each other both a list of all arguably relevant documents and copies of those documents. The Notice of Confirmation of Hearing, dated June 4, 2012, set out the steps to be taken by the parties in advance of the hearing. The deadline for disclosure pursuant to Rule 16 was June 25, 2012.
3The applicant appears to have provided the respondent with a list of all arguably relevant documents but not copies of the documents.
4The applicant is directed to comply with the requirements of Rule 16.1 in accordance with the Notice of Confirmation of Hearing dated June 4, 2012, and provide the respondent with copies of all arguably relevant documents within 15 days of the date of this Interim Decision. Failure to comply with Rule 16 may result in the Tribunal refusing permission to introduce documents or evidence of witnesses that have not been disclosed in accordance with the Rules.
