1This is an Application filed under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”). A hearing is scheduled for February 6 and 7, 2012.
2Two Case Assessment Directions (“CADs”) have been issued, dated December 19, 2011 and January 10, 2012, respectively, directing the applicant to take certain steps in preparation for the hearing. In particular, the second of the two CADs directed that the applicant immediately file the materials required under Rules 16 and 17 of the Tribunal’s Rules of Practice. The CAD further indicated that if the applicant did not do so by January 18, 2012, the Application may be dismissed as abandoned.
3Neither CAD has been returned as undeliverable. The applicant has not filed any documents or contacted the Tribunal orally or in writing and his timelines for doing so as set out in the CAD discussed above have now passed.
4Prior to this Decision being issued, the respondent filed a Form 10 seeking an Order dismissing this Application as abandoned. In the circumstances, I do not find it necessary to allow the applicant a further 14 days to respond to the Form 10.
5This Application is dismissed as abandoned.
