Introduction
1This is an Interim Decision in respect of an Application filed under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code"), alleging discrimination with respect to employment because of disability.
2The Application was filed on May 1, 2012. The respondent has filed a Response.
3On August 1, 2012, counsel for the applicant filed a Request for an order During Proceedings seeking leave to amend the Application. The respondents have been served with the Request, but have not responded, and the time for doing so has passed.
4The applicant indicates that he filed the Application before he retained counsel, and that he did not plead the full particulars of the allegations. The proposed amendments add considerably more detail.
5A hearing date has not been set. The parties have indicated their willingness to undertake mediation. The timing of the requested amendments does not appear to me to raise issues of unfairness to the respondent. The applicant's Request to amend the Application according to the new text filed with the request is allowed.
6The respondent may file any further Response it may wish to submit within thirty days of the date of this Interim Decision.
7A date for mediation will be set in the usual course.
8I am not seized of this matter.
