1This is an Application filed under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging discrimination on the basis of disability in the area of goods, services and facilities.
2In a Case Assessment Direction dated May 7, 2012, the Tribunal directed that a summary hearing be held to determine whether the Application should be dismissed, in whole or in part, on the basis that there is no reasonable prospect that the Application will succeed, as against the University of Windsor, York University, Queen’s University at Kingston, and the University of Ottawa (the “university respondents”).
3A summary hearing by teleconference was scheduled for September 24, 2012. At the outset of the summary hearing, the applicant advised that he wished to withdraw the Application as against the university respondents only. The university respondents had no objection to the applicant’s request. In the circumstances, I ordered that the applicant’s request that the Application be withdrawn as against the four university respondents be granted. The university respondents will be removed from the style of cause in any future decisions of the Tribunal in this matter.
