DECISION
Adjudicator: Sheri D. Price
Indexed as: Leonard v. Ontario (Community Safety and Correctional Services)
1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the "Code"), on July 15, 2011.
2By Interim Decision dated November 9, 2011, the Tribunal deferred the Application pending the conclusion of ongoing grievance proceedings: 2011 HRTO 2041.
3By letter dated August 14, 2012, the Tribunal directed the applicant to advise the Tribunal within 30 days of the date of the letter whether the grievance proceedings were still ongoing and, if possible, to indicate when they were expected to be completed. The letter went on to warn the applicant that failure to provide the requested information might result in the Tribunal dismissing the Application as abandoned. The Tribunal's letter was mailed to the applicant at the address provided by her to the Tribunal and was not returned as undeliverable.
4The applicant has not responded to the Tribunal's August 14, 2012 letter and the time for doing so has now passed.
5In the circumstances, the applicant is deemed to have abandoned the Application. The Application is dismissed accordingly.
Dated at Toronto, this 24th day of September, 2012.
