1This is an Application filed under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code").
2The hearing into this matter was scheduled for September 24 and 25, 2012.
3The Notice of Confirmation of Hearing was sent to the parties on February 9, 2012, advising that the hearing would commence at 9:30 p.m. on September 24, 2012. The Notice of Confirmation of Hearing also advised the parties that the hearing would take place at the Tribunal's hearing centre, 655 Bay Street, 14th Floor, Toronto, Ontario. The Notice of Confirmation of Hearing was mailed to the applicant and the respondent at the addresses provided by them to the Tribunal.
4The hearing was convened on September 24, 2012 at the scheduled time. Neither the applicant nor the respondent was present at the summary hearing.
5I remained at the hearing until 10:20 p.m. At 10:20 p.m. the applicant and the respondent were still not present.
6I was satisfied at the hearing that the applicant and respondent had received Notice of Confirmation of Hearing. There was no indication that the applicant or the respondent would not be attending the hearing. In the absence of the applicant or any explanation for her failure to attend the hearing and in the absence of the respondent, I dismissed the Application as abandoned.
