Introduction
1This is an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended. The applicant alleges that the visual acuity requirements for drivers’ licenses in Ontario constitute discrimination with respect to goods, services, and facilities because of disability.
2In an Interim Decision dated August 16, 2012, 2012 HRTO 1583 (the “Interim Decision”), the Tribunal dismissed the Application against the License Appeal Tribunal as abandoned.
3In the Interim Decision the Tribunal directed the applicant to file a Reply to the Response filed by the Ministry of Transportation and to make submissions on the jurisdictional issues raised by the Ministry.
4The applicant has failed to file a Reply or submissions as directed and I am satisfied that the applicant received the Interim Decision.
5The Application is dismissed as abandoned.
