1This is an Application filed under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
2The respondent failed to file a Response to the Application and pursuant to an Interim Decision dated April 20, 2012, the Tribunal deemed the respondent to have waived all rights to notice or participation in these proceedings. In addition, the Interim Decision ordered the applicant to advise the Tribunal in writing whether or not she wished to make oral submissions at a hearing via conference call before the Tribunal finally determines the Application. By email dated May 30, 2012, the applicant advised the Tribunal that she wished to make oral submissions via conference call.
3Notice of Confirmation of Hearing was sent to the applicant on June 12, 2012, advising that the hearing would commence at 9:30 a.m. on September 6, 2012, and would end at 10:30 a.m. The Notice of Confirmation of Hearing also advised the applicant how to connect to the teleconference. The Notice of Confirmation of Hearing was mailed to the applicant at the address provided by her to the Tribunal.
4The hearing was convened by teleconference on September 6, 2012, at the scheduled time. The applicant was not present at the hearing.
5I am satisfied that the applicant had received the Notice of Confirmation of Hearing. There was no indication that the applicant would not be attending the hearing. In the absence of the applicant or any explanation for her failure to attend the hearing, the Application is dismissed as abandoned.
