1In a letter dated July 9, 2010 the Tribunal deferred this Application, on the consent of the parties, pending the conclusion of a hearing before the Workplace Safety and Insurance Board. That proceeding has now concluded through following a decision of the Workplace Safety and Insurance Appeals Tribunal on June 19, 2012. The applicant has now filed a Request to re-activate the Application under Rule 14.3.

2The respondent consents to the request to re-activate the Application.

3In the circumstances, the request to proceed is appropriate and is granted. The Registrar shall schedule the Application for a hearing.
