1In a previous Interim Decision, 2010 HRTO 2317, the Tribunal deferred this Application pending the conclusion of a hearing before the Workplace Safety and Insurance Board. That proceeding has now concluded following a decision of the Workplace Safety and Insurance Appeals Tribunal on May 11, 2012. The applicant has now filed a Request to reactivate the Application under Rule 14.3.

2The person identified in the respondent’s Response as its representative has asserted that the respondent changed ownership in 2009 and is no longer in business.

3In the circumstances, the request to proceed is appropriate and is granted. The information available does not indicate the respondent company is bankrupt or no longer a legal entity. The Registrar shall schedule the Application for a hearing.
