1This is an Application filed under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”) alleging discrimination with respect to employment because of race, colour and sex.

2In her Application the applicant identified a third respondent, an individual, in addition to those respondents reflected on the style of cause. The individual in question is no longer an employee of the organization respondent and attempts to deliver a copy of the Application to him were unsuccessful.

3By Case Assessment Direction dated July 24, 2012, the Tribunal stated as follows:

… In the circumstances it appears that he must be removed from the Application. If any party objects to his removal as a respondent they may deliver and file their submissions within 14 days of the date of this Direction failing which the individual respondent will be removed.

4No party has filed any submissions to the CAD and the time for doing so has elapsed.

5The individual respondent is removed as a party and the style of cause is amended accordingly.
