1This is an Application filed under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging discrimination with respect to employment because of ethnic origin. The parties attempted mediation-adjudication on the first day of the hearing held on June 6, 2012, but no settlement was reached, and a continuation of the hearing was set for August 21, 2012. The applicant today, one day prior to the continuation of the hearing, filed a Request to Withdraw his Application.
2The respondent opposes the Request on the basis that it has been filed on the eve of the hearing on the Application’s merits, and on the basis that the applicant has allegedly abused the process.
3In these circumstances, where the applicant has made clear his intention not to appear at the hearing tomorrow, and where no evidence has yet been adduced, it is appropriate to grant the applicant’s Request.
4The Application is withdrawn with leave of the Tribunal, and the hearing tomorrow is cancelled.
