1This is an Application filed under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging discrimination with respect to employment because of disability.
2On review of the submissions of the applicant and the affected party, Sault Ste. Marie Police Association, the Tribunal determines that it will proceed with the Application rather than deferring to the grievance process. No one takes the position that the Application should be deferred, it is not clear whether all of the human rights issues raised by the applicant are part of the grievance process, or that the applicant’s grievance will proceed to arbitration.
3The respondents will have thirty-five days to file a Response to the Application.
4The applicant has agreed to try mediation to resolve the Application. The Tribunal encourages the respondents to choose mediation to resolve the Application.
